Welcome to Grateful. Please read these Terms of Service ("Terms") carefully before using the Grateful mobile application ("App") operated by Mike Lyons ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Use of the App
Grateful is a personal gratitude journaling application designed to help you reflect on and record things you are grateful for. The App is provided for your personal, non-commercial use.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates any applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Use the App to transmit any harmful or malicious content
2. Account and Data
Grateful does not require you to create an account. Your journal entries and personal data are stored locally on your device and, if you enable iCloud sync (Premium feature), in your personal iCloud account.
You are responsible for:
- Maintaining the security of your device
- Backing up your data (we recommend enabling iCloud sync)
- Any content you create within the App
3. Subscriptions and Payments
Grateful offers a free version with core features and an optional Premium subscription with additional features.
3.1 Premium Subscription
Premium subscriptions are available as:
- Monthly subscription at $4.99/month
- Annual subscription at $29.99/year
Prices may vary by region and are subject to change.
3.2 Billing
All subscriptions are processed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases.
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions in your App Store account settings
3.3 Free Trial
We may offer free trials of Premium features. If you do not cancel before the trial ends, you will be automatically charged the subscription fee.
3.4 Refunds
Refund requests are handled by Apple according to their App Store policies. We do not have the ability to process refunds directly.
4. Intellectual Property
The App and its original content, features, and functionality are owned by Mike Lyons and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you create within the App (your journal entries, photos, etc.). By using the App, you do not transfer any ownership rights to us.
5. Third-Party Services
The App may integrate with third-party services including:
- Apple iCloud: For optional data synchronization
- Apple App Store: For subscription management
Your use of these services is subject to their respective terms and conditions.
6. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of content
- Uninterrupted or error-free operation
Grateful is a journaling tool and is not intended to provide medical, psychological, or therapeutic advice. If you are experiencing mental health challenges, please consult a qualified healthcare professional.
7. Limitation of Liability
To the maximum extent permitted by law, Mike Lyons shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data
- Loss of profits or revenue
- Loss of use or functionality
Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Mike Lyons from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
9. Changes to the App
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and Mike Lyons regarding the use of the App and supersede any prior agreements.
